New York Vaccine Autism Lawyer
Although most health organizations say that there is no relationship between vaccines and autism many parents and smaller research groups are convinced there is more to the story. Doubts about the safety of vaccines linger in the minds of many parents.
Autism is a disorder which has severe effects on the development of a child. The causes of Autism continue to be studied by the medical community. There is mounting evidence that a mercury-based preservative known as Thimerosal which is widely used in childhood vaccines is one cause of the disorder. For years governmental agencies such as the Center for Disease Control (CDC) and National Institutes for Health (NIH) have stated there was no relationship between childhood vaccines and Autism. Parents, however in increasing numbers, report changes in their children following vaccination or a series of vaccinations. These changes often include a loss of milestones, loss of coordination, delayed speech, loss of motor skills, poor eye contact and changes in behavior.
The Federal Government has enacted a law known as The National Childhood Vaccine Injury Act of 1986 that allows individuals who have been injured from vaccines to be compensated from a vaccine administrator or manufacturer for past and future costs of services such as rehabilitation, special education, therapy, and other necessary treatment. A victim may also be entitled to compensation for his or her future loss of earnings, as well as past and future pain and suffering.
The National Childhood Vaccine Injury Act of 1986 provides that all lawsuits for vaccine related injuries are to be filed with the National Vaccine Injury Program (VICP) which determines whether or not a child is entitled to any compensation, and if so, the amount he or she deserves. Recently, the U.S. Department of Health and Human Services, ruled that a young girl who developed Autism was entitled to compensation for her vaccine related injury. The ruling found that the child had a predisposing condition that was aggravated by the vaccine which led to her development of Autism. Although the decision of the VICP indicated that this was an isolated case, and did not acknowledge that vaccines cause Autism in general, this does not preclude other individuals from commencing their own proceedings in the VICP.
We are confident that as evidence in the medical community continues to connect the relationship between vaccines and Autism, there will be more rulings in favor of victims who developed Autism from exposure to vaccines.
