Patients At Risk for HIV & Hepatitis After Doctor Finkelstein Reused Needles

Dr. Harvey Finkelstein may have spread hepatitis by dipping syringes more than once into medicine vials.

State health officials say Dr. Finkelstein, who specializes in pain management, used syringes multiple times on the same patients, possibly contaminating vials of medications when the syringes were reinserted. Health officials say the practice caused at least two patients to be infected with hepatitis C, a potentially fatal liver disease.

New York State Health Commissioner Richard Daines stated that "It's unacceptable'', "It's very serious that he put a lot of people at risk''.

However, the Health Department did not consider Dr. Finkelstein's conduct egregious enough to suspend his medical license, agency spokeswoman Claudia Hutton said. She said authorities advised him on proper procedures after they observed his technique in January 2005.

Dr. Finkelstein continues to practice at Pain Care of Long Island, in Plainview.

The state Health Department sent letters urging more than 600 of Dr. Finkelstein's patients, treated between 2000 and 2005, to be tested for hepatitis and the HIV virus.

Nassau County Executive Thomas Suozzi criticized state authorities for not notifying patients sooner, although Mr. Suozzi said Dr. Finkelstein's lawyers had slowed the process. Commissioner Daines said his agency worked "as quickly as possible.''
